1. Introduction
1.1. Agreement to Terms
Welcome to Generocity App! These Terms and Conditions ("Terms") govern your access to and use of www.generocityapp.com and the Generocity App mobile application (collectively, the "Platform"), operated by Not for Keeps LLC ("Generocity," "we," "us," or "our"). By using our Platform, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Platform.
1.2. Platform Purpose
Generocity App is a community social impact platform that allows users to create customized registries of needed items and enables donors to provide meaningful support through direct item donations. Our Platform serves to connect those in need with those who wish to help by simplifying the donation process.
1.3. Service Updates
We reserve the right to modify, update, or discontinue any aspect of our Platform at any time. We will make reasonable efforts to notify users of significant changes that affect core functionality.
2. User Accounts
2.1. Account Creation
To use certain features of our Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
2.2. Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- Restricting access to your account
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
2.3. Age Restrictions
Users must be at least 18 years old to create an account. Users between 13 and 18 years old may only use the Platform with parental or guardian supervision and consent. We do not knowingly collect information from children under 13.
3. Registry Creation and Management
3.1. Registry Guidelines
When creating a registry, you agree to:
- Provide accurate and truthful information about needed items
- Only list items that serve legitimate needs
- Maintain and update your registry to reflect current needs
- Not create duplicate or unnecessary registries
3.2. Prohibited Items
Users may not create registries for or request:
- Illegal items or substances
- Dangerous or hazardous materials
- Weapons or ammunition
- Adult content or services
- Currency or cash equivalents
- Items intended for resale
3.3. Registry Monitoring
We reserve the right to:
- Review registry contents
- Remove inappropriate items or registries
- Suspend or terminate accounts that violate these Terms
- Report illegal activity to appropriate authorities
4. Donations and Transactions
4.1. Donation Process
Donors agree that:
- All donations are voluntary
- Items donated must match registry requests
- Donations cannot be exchanged for cash or other consideration
- We are not responsible for the quality of donated items
4.2. Platform Role
Generocity App serves as a platform to connect donors with recipients. We:
- Do not take possession of donated items
- Do not guarantee the condition of donated items
- Are not responsible for shipping or delivery arrangements
- Do not mediate disputes between users
5. Intellectual Property
5.1. Platform Content
All content on our Platform, including but not limited to text, graphics, logos, and software, is the property of Generocity or its licensors and is protected by copyright and other intellectual property laws.
5.2. User Content
By posting content on our Platform, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, publicly display, and distribute such content on our Platform.
6. Privacy and Data Protection
6.1. Data Collection
We collect and process personal information as described in our Privacy Policy. By using our Platform, you consent to such processing and guarantee that all data provided by you is accurate.
6.2. Data Security
We implement reasonable security measures to protect user data but cannot guarantee absolute security. Users are responsible for maintaining the security of their account credentials.
7. Liability and Disclaimers
7.1. Service Disclaimer
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, secure, or error-free.
7.2. Limitation of Liability
To the maximum extent permitted by law, Generocity shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Platform.
8. Dispute Resolution
8.1. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
8.2. Arbitration
Any dispute arising from these Terms shall be resolved through binding arbitration conducted by the American Arbitration Association under its Commercial Arbitration Rules.
9. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Platform. Your continued use of the Platform after such modifications constitutes acceptance of the updated Terms.
